Omnilex summary

The Federal Administrative Court upheld the joined party’s non-admission complaint in a telecommunications regulation case. It held that the matter had fundamental significance because it could clarify whether a temporary approval of wholesale access charges gives competitors legitimate expectations regarding a later approval of higher charges for the remaining period. The court also set the dispute value for the complaint and the provisional appeal proceedings.

Omnilex headnote

A case has fundamental significance if it raises a legal question of general relevance that is capable of clarification in appeal proceedings. In particular, it may be decisive whether a time-limited approval of wholesale access charges can create legitimate expectations protecting competitors against a later approval of higher charges for the remaining period (consid. 1). The dispute value is to be fixed under the GKG provisions cited by the court (consid. 2).
