Gründe

1 Mit Beschluss vom 16. Juni 2010 hat das Bundesverwaltungsgericht gemäß § 106 Satz 2 VwGO den Parteien den Abschluss eines Vergleichs vorgeschlagen. Der Beklagte hat dem Vergleichsvorschlag mit Schriftsatz vom 28. Juni 2010 zugestimmt. Der Kläger hat mit Schriftsatz vom 29. Juni 2010 dem vorgeschlagenen Vergleich ebenfalls zugestimmt. Damit ist das Verfahren durch Abschluss eines gerichtlichen Vergleichs beendet worden (vgl. § 106 Satz 2 VwGO). Es ist deshalb einzustellen. Die Urteile des Thüringer Oberverwaltungsgerichts vom 26. November 2008 und des Verwaltungsgerichts Gera vom 17. Juli 2006 sind für wirkungslos zu erklären.
