1 Die Beschwerde der Kläger gegen die Nichtzulassung der Revision ist begründet. Die Rechtssache hat die geltend gemachte grundsätzliche Bedeutung im Sinne des § 132 Abs. 2 Nr. 1 VwGO. Sie wirft die im Revisionsverfahren voraussichtlich klärungsbedürftige Frage auf, ob eine Weisungsgebundenheit der auf Vorschlag der Gemeinde gewählten Mitglieder des Aufsichtsrates einer GmbH, an der die Gemeinde beteiligt ist, mit Gesellschaftsrecht, insbesondere mit § 52 GmbHG vereinbar ist.
