Omnilex summary

The Federal Administrative Court admitted the revision in a dispute concerning the amendment of a permit-requiring installation and the extension of a deadline. It held that the effect of a release declaration under § 15(2) sentence 2 BImSchG for the requirement in § 18(3) BImSchG that the extension must not endanger the purpose of the statute raises a question of fundamental importance. The answer depends, among other things, on what is covered by the final and binding subject matter of the release declaration and any resulting binding effect.

Omnilex headnote
