Omnilex summary

The Federal Administrative Court granted legal aid and admitted the revision. It held that the case is of fundamental importance because it raises the question whether a permanent residence title granted to a foreigner continues to apply, revives, or supports a claim to reissue the title after naturalization is retroactively annulled.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; fundamental importance of a case concerning the effect of the retroactive annulment of naturalization on an existing residence title. Revision is to be admitted where the proceeding raises an unresolved question of general significance, here whether a permanent residence permit continues in force, revives, or gives rise to a claim for reissue after the acquisition of German nationality is undone ex tunc. The existence of such a question suffices irrespective of the merits of the lower-court decision; decisive is that clarification is required in the interests of uniform application of the law (consid. 3).
