Leitsatz

Einigen sich die Kläger mit einem Beigeladenen anlässlich einer außergerichtlich vereinbarten Klagerücknahme über die Kostentragung, ist diese Vereinbarung für die gerichtliche Kostenentscheidung bindend.

Gründe

1 Die Kläger haben ihre Klage mit Schriftsatz vom 17. Januar 2017 zurückgenommen. Das Verfahren ist daher gemäß § 92 Abs. 3 Satz 1 VwGO einzustellen.

2 Die Kostenentscheidung folgt der vergleichsweise getroffenen Vereinbarung der Kläger mit der Beigeladenen, auf die sich die Kläger anlässlich ihrer Klagerücknahme berufen haben. Über diese Vereinbarung kann sich das Gericht nicht hinwegsetzen (vgl. Geiger, in: Eyermann, VwGO, 14. Aufl. 2014, § 160 Rn. 10; Wysk, in: ders., VwGO, 2. Aufl. 2016, § 160 Rn. 11). Soweit es um die außergerichtlichen Kosten der nicht am Vergleich beteiligten Beklagten geht, haben es die Vergleichsparteien bei der ohnehin geltenden Regelung in § 155 Abs. 2 VwGO belassen. Die gesamtschuldnerische Kostentragung der Kläger ist, weil das streitige Rechtsverhältnis ihnen gegenüber nur einheitlich entschieden werden konnte, gemäß § 159 Satz 2 VwGO anzuordnen.

3 Die Streitwertfestsetzung beruht auf § 52 Abs. 1 GKG.
