Omnilex summary

The Federal Administrative Court considered a complaint, construed as directed only at the husband’s inclusion in an admission notice, admissible and well-founded. It granted leave to appeal because the case raised a question of fundamental importance: when a spouse already living in Germany must possess basic German language skills for a later inclusion under § 27(2) sentence 1 BVFG. The court also provisionally fixed the value in dispute.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; § 27 Abs. 2 Satz 1 BVFG; criteria for leave to appeal in cases concerning subsequent inclusion of a spouse in an admission notice. Revision is to be admitted where the proceedings raise a question of fundamental importance requiring clarification by the Federal Administrative Court. In particular, it is of fundamental importance whether, in the case of subsequent inclusion of a spouse already residing in Germany, the requisite basic knowledge of the German language must be present at the time of the application, at the time of the administrative decision, or at another legally relevant point in time (consid. 2). A purposive interpretation may limit the scope of the complaint to the inclusion of one spouse if this corresponds to the appellant’s legal interest.

Key legal question

Whether the complaint justifies granting leave to appeal on the ground of fundamental importance.

Extracted holding

Leave to appeal was granted because the case raises a question of fundamental importance under § 132(2) No. 1 VwGO.

Extracted reasoning

The court held that revision may clarify at what point, in a subsequent inclusion in an admission notice, a spouse already living in Germany must possess basic German language skills within the meaning of § 27(2) sentence 1 BVFG.

Key legal question

Challenge to the proposed limited inclusion of the husband in the admission notice.

Extracted holding

The complaint, construed purposively as limited to the husband's inclusion, was admissible and well-founded.

Extracted reasoning

On a purposive interpretation, the legal remedy was directed only at inclusion of the husband; this sufficed for admissibility and success of the complaint for leave purposes.
