Omnilex summary

The Federal Administrative Court granted the complaint and admitted revision. It held that the case raises a question of fundamental importance concerning the requirements for a member-state opt-out rule on voluntary overtime in fire service beyond a 48-hour weekly working time limit under Art. 22(1) of Directive 2003/88/EC. The court considered the revision proceedings suitable to clarify that question.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance. A complaint against non-admission of revision is successful where the case raises a legally unresolved question of general significance whose clarification is suitable in revision proceedings. This is so in particular where the litigation concerns the requirements for a member-state opt-out rule allowing voluntary additional shift work in fire service beyond the 48-hour weekly working time limit under Art. 22(1) of Directive 2003/88/EC.
