Gründe

1 Die Beschwerde hat Erfolg. Der Rechtssache kommt die geltend gemachte grundsätzliche Bedeutung gemäß § 132 Abs. 2 Nr. 1 VwGO zu.

2 Die Beschwerdebegründung führt auf die voraussichtlich im Revisionsverfahren zu klärende Frage, ob der Zweck von § 1 Abs. 2 Satz 2 des Gesetzes zur Regelung in der Deutschen Demokratischen Republik nicht erfüllter Entschädigungsansprüche aus Enteignung (DDR-Entschädigungserfüllungsgesetz - DDR-EErfG) vom 10. Dezember 2003 (BGBl. I S. 2471, ber. BGBl. I 2004 S. 1654) eine Auslegung von dessen Tatbestandsmerkmal der Beteiligungen von ausländischen Gesellschaftern an enteigneten Unternehmensträgern verlangt, wonach die Fiktion des Nichterwerbs aus Art. 13 der Rückerstattungsanordnung BK/O (49) 180 für das Land Berlin (REAO) vom 26. Juli 1949 (VOBl. I S. 221) nicht gilt, sondern es auf die tatsächliche Lage der Dinge ankommt.

3 Die vorläufige Streitwertfestsetzung beruht auf § 47 Abs. 1, § 52 Abs. 3 und § 63 Abs. 1 Satz 1 GKG.
