Omnilex summary

The Federal Administrative Court allowed the claimants' complaint and admitted the revision. It held that the case raises a question of fundamental importance under Section 132(2)(1) VwGO, in particular concerning the relationship between Section 26a Asylum Act and Section 27a Asylum Act. The additional ground of divergence, including the alleged conflict with the Court's decision of 23 October 2015, did not affect the outcome.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; revision on grounds of fundamental importance. Fundamental importance exists where the dispute is suitable to clarify an unresolved question of federal law of general significance. In asylum matters, the relationship between § 26a AsylG and § 27a AsylG may constitute such a question. If one admissibility ground is established, further asserted grounds need not be examined; an alleged divergence is irrelevant once leave to appeal is granted on another independent basis (consid. 2).

Key legal question

Whether revision should be admitted because the case raises a question of fundamental importance, especially the relationship between Section 26a Asylum Act and Section 27a Asylum Act.

Extracted holding

Revision is admitted because the case may clarify the relationship between Section 26a Asylum Act and Section 27a Asylum Act.

Extracted reasoning

The asserted question of fundamental importance under Section 132(2)(1) VwGO is satisfied. The court noted that the complaint could in particular provide an opportunity to clarify the interaction between the two statutory provisions. The additional asserted grounds, including the alleged divergence, do not prevail.
