Gründe

1 Die Beschwerde des Klägers gegen die Nichtzulassung der Revision ist begründet. Die Rechtssache hat grundsätzliche Bedeutung (§ 132 Abs. 2 Nr. 1 VwGO). Sie kann dem Senat Gelegenheit geben, die Rechtsprechung zum Umfang der Prüfungsbefugnis der Flurbereinigungsbehörde bei Einleitung eines Unternehmensflurbereinigungsverfahrens auf Antrag der Enteignungsbehörde (§ 87 Abs. 1 FlurbG) fortzuentwickeln.

2 Die vorläufige Streitwertfestsetzung für das Revisionsverfahren beruht auf § 47 Abs. 1 i.V.m. § 52 Abs. 2, § 63 Abs. 1 Satz GKG.
