Omnilex summary

The Federal Administrative Court upheld the complaint against non-admission of revision. It held that the matter warrants review because revision can clarify whether a municipality must re-exhibit a draft development plan and re-seek submissions when the environmental report attached to the draft is amended after public participation and authority consultation. No substantive planning decision was made; the court only admitted revision.

Omnilex headnote

§ 132 Abs. 2 Nr. 1 VwGO; admission of revision for fundamental importance in planning-law disputes concerning renewed participation under §§ 3 Abs. 2, 4 Abs. 2, 4a Abs. 3 Satz 1 BauGB. A question is of fundamental importance where its clarification in revision proceedings may contribute to determining whether, and under which conditions, an amended environmental report appended to a draft development plan triggers renewed public display and renewed solicitation of statements. The mere need for further clarification of the statutory participation regime suffices for leave to appeal; the Senate need not decide the substantive question at the admissibility stage (consid. 1).
