Omnilex summary

The Federal Administrative Court admitted the plaintiff's revision because the case has fundamental significance under Section 132(2)(1) VwGO. The court found that the proposed question is suitable for clarification in revision proceedings, namely whether the rule-of-law and democratic principles prevent the legislature from enacting a regulation for the first time when doing so in the context of revising a complex regulatory framework. It also provisionally set the dispute value for the revision proceedings in accordance with the appellate court's assessment.
