1 Die Beschwerde des Klägers ist zulässig und begründet. Die Revision ist nach § 132 Abs. 2 Satz 1 VwGO wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen.

2 Die Revision kann dem Senat Gelegenheit geben, die grundsätzliche Frage zu klären, ob die typisierende Anknüpfung in § 5 Abs. 6 Satz 1 WoGG an das Sorgerecht getrennt lebender Eltern mit grundrechtlichen Anforderungen aus Art. 3 und 6 GG zu vereinbaren ist.
