Omnilex summary

The Federal Administrative Court granted the claimant's complaint against non-admission of revision in a dispute over telecommunications fee approval. It held that the case has fundamental significance because it may clarify whether the constitutive effect of a fee approval under Section 37(2) TKG presupposes a contractual basis for the payment claim. The decision did not resolve the merits of the underlying fee dispute. The court also noted the applicable basis for the interim and preliminary value assessments.

Omnilex headnote
