1 Die zulässige Beschwerde der Klägerin ist begründet. Die Revision ist wegen grundsätzlicher Bedeutung der Rechtssache zuzulassen (§ 132 Abs. 2 Nr. 1 VwGO). Die Rechtssache wirft jedenfalls die angesichts des von der Europäischen Kommission gegen die Bundesrepublik Deutschland eingeleiteten Vertragsverletzungsverfahrens (EuGH Rs. C-137/14) erneut klärungsbedürftige Frage auf, ob die Bestimmungen über den Ausschluss der Einwendungen in § 73 Abs. 4 Satz 3 SVwVfG mit dem Recht der Europäischen Union vereinbar sind.

2 Die Festsetzung des Streitwerts beruht für das Beschwerdeverfahren auf § 47 Abs. 1 Satz 1, Abs. 3, § 52 Abs. 1 GKG, für das Revisionsverfahren auf § 47 Abs. 1 Satz 1, § 52 Abs. 1, § 63 Abs. 1 GKG.
