Gründe

1 Die Beschwerde gegen die Nichtzulassung der Revision ist begründet. Der Rechtssache kommt grundsätzliche Bedeutung zu (§ 132 Abs. 2 Nr. 1 VwGO). Im Revisionsverfahren ist voraussichtlich die von der Antragsgegnerin sinngemäß bezeichnete Rechtsfrage zu klären, ob § 16 EEWärmeG dahin auszulegen ist, dass über die - vom Bundesgesetzgeber angenommene - generelle Eignung der den Anforderungen dieses Gesetzes entsprechenden Fernwärmeversorgung zum globalen Klimaschutz hinaus die Anordnung eines Anschluss- und Benutzungszwangs zugunsten einer kommunalen Einrichtung der Fernwärmeversorgung zusätzlich voraussetzt, dass die Einrichtung auch im räumlichen Geltungsbereich der Satzung selbst - insofern also örtlich-konkret - zu einer Verminderung der CO2-Emissionen beiträgt.
