Leitsatz

NV: Wird in einem Revisionsverfahren gerügt, § 62 Abs. 2 Nr. 3 Buchst. b EStG sei verfassungswidrig, erscheint es zweckmäßig, das Verfahren bis zu einer Entscheidung des BVerfG in den Verfahren 2 BvL 9-14/14 ruhen zu lassen, wenn beide Beteiligte das Ruhen des Verfahrens beantragt haben und die Vorschrift entscheidungserheblich ist .

Tatbestand

1 I. Zwischen den Beteiligten besteht Streit darüber, ob § 62 Abs. 2 Nr. 3 Buchst. b des Einkommensteuergesetzes (EStG) verfassungsgemäß ist.

2 Mit Schriftsatz vom 31. März 2014 hat die Klägerin und Revisionsklägerin beantragt, das Verfahren bis zu einer Entscheidung des Bundesverfassungsgerichts in den Verfahren 2 BvL 9-14/14 ruhen zu lassen. Die Beklagte und Revisionsbeklagte hat unter dem 28. April 2014 mitgeteilt, dass sie mit einem Ruhen einverstanden ist.

3 II. Die Entscheidung beruht auf § 155 der Finanzgerichtsordnung i.V.m. § 251 der Zivilprozessordnung.

Das von den Beteiligten beantragte Ruhen des Verfahrens ist zweckmäßig, weil Gegenstand der Normenkontrollverfahren 2 BvL 9-14/14 die Verfassungsmäßigkeit des § 62 Abs. 2 EStG ist, nach der ein nicht freizügigkeitsberechtigter Ausländer --abhängig von der Art seines Aufenthaltsstatus-- teilweise keinen Anspruch auf Kindergeld hat, teilweise ohne weitere Voraussetzungen und teilweise nur bei Vorliegen weiterer Voraussetzungen einen Anspruch auf Kindergeld hat (vgl. dazu die Angaben in juris und in der Anhängigkeitsliste des Bundesfinanzhofs --BFH--, abrufbar unter www.bundesfinanzhof.de). Diese Vorschrift ist auch im Streitfall entscheidungserheblich.

5 2. Eine Kostenentscheidung ist nicht zu treffen (vgl. BFH-Beschluss vom 26. September 2007 X R 54/03, BFH/NV 2008, 66).
