NV: Hat der BFH beim Erlass eines Revisionsurteils einen während des Revisionsverfahrens ergangenen Änderungsbescheid übersehen, ist dies auf einen rechtzeitig gestellten Antrag in entsprechender Anwendung des § 109 FGO durch Ergänzungsurteil zu berichtigen .

Tatbestand

1 I. Der Bundesfinanzhof (BFH) hat im Urteil vom 27. Oktober 2010 II R 37/09 den Schenkungsteuerbescheid des Beklagten und Revisionsbeklagten (Finanzamt --FA--) vom 10. März 2009 übersehen, durch den die Schenkungsteuer für die freigebige Zuwendung vom 22. November 2004 der Vorentscheidung entsprechend auf 147.053 € herabgesetzt wurde, und dementsprechend die Steuer für diese freigebige Zuwendung unter Änderung des Steuerbescheids vom 19. September 2005 in Gestalt der Einspruchsentscheidung vom 31. Mai 2006 auf 2.864 € herabgesetzt. Das Urteil wurde der Klägerin und Revisionsklägerin (Klägerin) am 8. Dezember 2010 zugestellt.

2 Mit Schreiben vom 10. Dezember 2010 weist die Klägerin auf den ergangenen Änderungsbescheid und ihren darauf bezogenen Revisionsantrag hin und beantragt, das Urteil vom 27. Oktober 2010 entsprechend zu berichtigen und zu ergänzen.

3 II. Der Antrag ist in entsprechender Anwendung des § 109 der Finanzgerichtsordnung (FGO) zulässig, insbesondere rechtzeitig eingegangen, und begründet.

4 Der Änderungsbescheid vom 10. März 2009 wurde gemäß § 121 Satz 1 i.V.m. § 68 Satz 1 FGO Gegenstand des Revisionsverfahrens. Der BFH hätte daher über diesen Bescheid und nicht über den ursprünglichen Bescheid in Gestalt der Einspruchsentscheidung entscheiden müssen. Dieser Fehler ist in entsprechender Anwendung des § 109 Abs. 1 FGO durch ein Ergänzungsurteil zu korrigieren (Schallmoser in Hübschmann/Hepp/Spitaler, § 68 FGO Rz 99; Seer in Tipke/Kruse, Abgabenordnung, Finanzgerichtsordnung, § 68 FGO Rz 24, je m.w.N.). Die im Urteil vom 27. Oktober 2010 für die freigebige Zuwendung vom 22. November 2004 festgesetzte Schenkungsteuer bleibt hiervon unberührt.

5 Die Entscheidung durch Urteil ohne mündliche Verhandlung beruht auf § 121 Satz 1 i.V.m. § 90 Abs. 2 FGO. Der Verzicht der Beteiligten auf Durchführung einer mündlichen Verhandlung wirkt für die Entscheidung nach § 109 FGO fort (BFH-Urteil vom 20. September 1989 X R 1/84, BFH/NV 1990, 513).
