NV: Ist das Urteil nicht mit einer Rechtsmittelbelehrung versehen, tritt an die Stelle der gesetzlichen Rechtsmittelfrist gemäß § 55 Abs. 2 FGO eine Ausschlussfrist von einem Jahr seit Zustellung des angefochtenen Urteils, innerhalb derer das Rechtsmittel sowohl eingelegt als auch begründet werden muss .

Gründe

1 Die Beschwerde wegen Nichtzulassung der Revision ist unzulässig, weil die Klägerin und Beschwerdeführerin (Klägerin) sie nicht innerhalb der Frist des § 55 Abs. 2 der Finanzgerichtsordnung (FGO) begründet hat. Das Urteil ist zwar nicht mit einer Rechtsmittelbelehrung versehen, so dass an die Stelle der gesetzlichen Rechtsmittelfrist gemäß § 55 Abs. 2 FGO eine Ausschlussfrist von einem Jahr seit Zustellung des angefochtenen Urteils getreten ist, innerhalb derer das Rechtsmittel sowohl eingelegt als auch begründet werden muss (Spindler in Hübschmann/Hepp/Spitaler, § 55 FGO Rz 45; Seer in Tipke/Kruse, AO/FGO, § 120 FGO Rz 72; Bundessozialgericht, Beschluss vom 22. August 1995 5 BJ 50/95, Monatsschrift für Deutsches Recht 1996, 414; Bundesverwaltungsgericht, Urteil vom 8. Februar 1968 III C 20.67, Höchstrichterliche Finanzrechtsprechung 1969, 38). Die Klägerin hat ihre Beschwerde jedoch bis heute nicht begründet, obwohl ihr das Urteil des Finanzgerichts bereits am 24. Juli 2009 zugestellt wurde.
