Leitsatz

NV: Durch den Erlass des Umsatzsteuerjahresbescheides kommt es nicht zu einer Änderung des Bescheides für den Umsatzsteuer-Voranmeldungszeitraum i.S.v. § 176 AO.

Gründe

1 Die Beschwerde hat keinen Erfolg.

2 1. Die von der Klägerin und Beschwerdeführerin (Klägerin) aufgeworfene Rechtsfrage, ob es sich "bei Voranmeldungs- und Steueranmeldungs- bzw. Festsetzungsverfahren um verschiedene Verfahren" handelt oder ob § 176 der Abgabenordnung (AO) "im Verhältnis Voranmeldung zur Steueranmeldung" gilt, hat keine grundsätzliche Bedeutung (§ 115 Abs. 2 Nr. 1 der Finanzgerichtsordnung --FGO--), da sich diese Frage bereits unmittelbar aus § 176 AO beantworten lässt. Nach § 176 Abs. 1 Satz 1 Nr. 1 AO darf eine Rechtsprechungsänderung eines obersten Gerichtshofes des Bundes bei "der Aufhebung oder Änderung eines Steuerbescheides nicht zuungunsten des Steuerpflichtigen berücksichtigt werden".

3 Mit den Begriffen der Aufhebung oder Änderung verweist § 176 Abs. 1 AO nach seinem Wortlaut auf § 172 Abs. 1 Satz 1 AO (vgl. auch Koenig, in Pahlke/Koenig, 2. Aufl. 2009, AO § 176 Rz 4), nicht aber auch auf die anderweitige Erledigung i.S. von § 124 Abs. 2 AO. Da nach ständiger Rechtsprechung des Bundesfinanzhofs (BFH) der Erlass des Umsatzsteuerjahresbescheides (§ 18 Abs. 3 des Umsatzsteuergesetzes --UStG--) zu einer anderweitigen Erledigung des Bescheides über den Umsatzsteuer-Voranmeldungszeitraum (§ 18 Abs. 1 und 2 UStG) i.S. von § 124 Abs. 2 AO führt (vgl. z.B. BFH-Urteil vom 29. November 1984 V R 146/83, BFHE 143, 101, BStBl II 1985, 370), kommt es durch den Erlass des Umsatzsteuerjahresbescheides nicht zu einer Änderung des Bescheides über den Umsatzsteuer-Voranmeldungszeitraum i.S. von § 176 AO (ebenso Kronthaler, in Sölch/Ringleb, UStG, § 18 Rz 61, und Bülow, in Vogel/Schwarz, UStG, § 18 Rz 132). Darüber hinaus regelt der Umsatzsteuerjahresbescheid ein mit den einzelnen Voranmeldungszeiträumen nicht identisches Steuerrechtsverhältnis (BFH-Urteil vom 15. Juni 1999 VII R 3/97, BFHE 189, 14, BStBl II 2000, 46, unter II.2.b bb ddd), wie sich bereits daraus ergibt, dass beide Bescheide --auch wenn sie dasselbe Kalenderjahr betreffen-- unterschiedliche Zeiträume dieses Jahres erfassen. Im Übrigen sind auch keine Umstände erkennbar, die es rechtfertigen könnten, das Vertrauen in einen Voranmeldungsbescheid zu schützen.

4 2. Auf die steuerstrafrechtliche Einordnung und das insoweit ergangene Urteil des Bundesgerichtshofs vom 1. November 1995 5 StR 535/95 (BStBl II 1996, 33) kommt es für die Auslegung des § 176 AO entgegen der Auffassung der Klägerin nicht an, so dass die Revision auch nicht zur Sicherung einer einheitlichen Rechtsprechung (§ 115 Abs. 2 Nr. 2 Alt. 2 FGO) zuzulassen ist.
