Omnilex summary

The Federal Constitutional Court did not accept the constitutional complaint for decision. It held that the complaint was inadmissible because the complainant had not exhausted the available administrative judicial remedies against the City B. certification dated 2004-04-20. The Court therefore abstained from giving any further reasoning under § 93d Abs. 1 sentence 3 BVerfGG.

Omnilex headnote

§ 93d Abs. 1 Satz 3 BVerfGG; constitutional complaint inadmissible for failure to exhaust remedies. A constitutional complaint is inadmissible where the complainant has not first pursued the available ordinary legal remedies, here the administrative court remedy against a municipal certification issued under the Investitionszulagengesetz 1999. The subsidiarity requirement applies irrespective of the merits of the asserted constitutional objections. If the prerequisite of exhaustion is missing, the Court may decline to admit the complaint without further reasoning.

Key legal question

Whether the constitutional complaint was admissible despite failure to exhaust the administrative remedy against the city certification of 2004.

Extracted holding

The complaint was not admitted because the complainant had not exhausted the administrative judicial remedy against the certification issued by the City B. on 2004-04-20.

Extracted reasoning

Under the subsidiarity principle, a constitutional complaint is inadmissible if the available prior legal remedies have not been pursued; the Court therefore declined to decide the complaint further.
