Omnilex summary

The complainant attacked the dismissal of her challenge to a negative ethics-committee opinion of the state medical association, alleging violations of academic freedom and effective judicial protection. The Federal Constitutional Court held the constitutional complaint inadmissible because she had not exhausted available remedies: in the administrative proceedings she had failed to substantiate the application for leave to appeal with respect to all possible grounds for admission, as required by Section 124a(4) sentence 4 VwGO. The Court therefore did not examine the merits.

Omnilex headnote

§ 90 Abs. 2 Satz 1 BVerfGG; subsidiarity of the constitutional complaint; a complaint is inadmissible if the complainant failed to pursue and exhaust available and reasonable procedural means before the Fachgerichte. This includes properly substantiating an application for leave to appeal in accordance with § 124a Abs. 4 Satz 4 VwGO with respect to all seriously conceivable grounds for admission. If that procedural burden is not met, alleged violations of fundamental rights are not reviewed on the merits by the Federal Constitutional Court (consid. 3).

Titelzeile

Nichtannahmebeschluss: Unzulässigkeit einer Verfassungsbeschwerde wegen Subsidiarität bei unzureichender Begründung eines Berufungszulassungsantrags (§ 124a Abs 4 S 4 VwGO) im fachgerichtlichen Verfahren

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Gründe

I.

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was admissible despite the complainant's failure to adequately substantiate all possible grounds for leave to appeal in the administrative courts.

Extracted holding

No; the complainant had not exhausted all reasonable possibilities to remedy any rights violation before the ordinary courts because the leave-to-appeal application was not sufficiently reasoned as to all serious grounds for admission.

Extracted reasoning

Under the subsidiarity principle, a constitutional complaint is inadmissible if the complainant failed to use available procedural means in the lower courts. Here, the leave-to-appeal application did not satisfy the requirements of Section 124a(4) sentence 4 VwGO, so the alleged rights violations were not fully pursued in the Fachgerichtsbarkeit.

Key legal question

Whether the complaint required further examination on the merits of alleged violations of academic freedom and effective judicial protection.

Extracted holding

No; because the complaint was inadmissible, the Court did not reach the merits.

Extracted reasoning

The absence of proper exhaustion of remedies prevented substantive review of the asserted rights under Articles 5(3) and 19(4) GG.
