Omnilex summary

The Federal Constitutional Court rejected the applicant’s renewed request for an interim injunction. It held that the requirements of § 32(1) BVerfGG remained unmet because the applicant did not sufficiently substantiate any serious disadvantage, threat of violence, or other compelling reason requiring urgent relief for the common good. The decision is final.

Omnilex headnote

§ 32 Abs. 1 BVerfGG; interim injunctions require substantiated showing of grave disadvantage, violence, or another compelling public-interest reason. A renewed application is inadmissible in substance if the applicant does not concretely and plausibly demonstrate the imminent harm alleged. The Court will not grant interim relief on the basis of mere assertion; the burden of substantiation remains with the applicant (consid. 1).

Titelzeile

Key legal question

Whether the renewed application for an interim injunction under § 32(1) BVerfGG was admissible and well-founded.

Extracted holding

The application was rejected because the applicant still did not substantiate any imminent serious disadvantage, violence, or another compelling public-interest reason requiring an interim order.

Extracted reasoning

The requirements of § 32(1) BVerfGG were not met; the application failed to explain in a sufficiently substantiated way what grave disadvantages would result without interim relief.
