Omnilex summary

The Federal Constitutional Court denied legal aid for an intended constitutional complaint against a Hessian Regional Social Court order. It held that the application showed no sufficient prospect of success and no apparent violation of fundamental rights or equivalent rights. The Court also refused the separate request to serve the legal-aid application on the opposing parties, finding no statutory basis for such a notification and noting that neither a constitutional complaint nor an isolated legal-aid request suspends limitation periods.

Omnilex headnote

§ 114 Abs. 1 S. 1 ZPO; legal aid for an intended constitutional complaint requires sufficient prospects of success and a substantiated presentation of the decisive facts. The Federal Constitutional Court may deny legal aid where no arguable violation of fundamental or equivalent rights is disclosed. The Federal Constitutional Court Act does not provide a right to have an isolated legal-aid application served on the opposing party; neither the constitutional complaint nor the isolated legal-aid request suspends limitation periods (consid. 2-3).

Titelzeile

Extracted by Omnilex

Key legal question

Whether legal aid should be granted for the intended constitutional complaint.

Extracted holding

Legal aid was denied because the intended complaint lacked sufficient prospects of success and no arguable violation of fundamental rights was apparent.

Extracted reasoning

In legal aid proceedings, the court may require the applicant to state the facts necessary to assess prospects of success; those requirements were not met here.

Key legal question

Whether the legal aid application had to be served on the opposing parties regardless of the prospects of success.

Extracted holding

No. The Federal Constitutional Court Act provides no basis for such a request, and neither a constitutional complaint nor an isolated legal-aid request suspends limitation periods.

Extracted reasoning

There is no statutory entitlement to notification of the adversary in this procedural setting.
