Omnilex headnote

§ 19 Abs. 1 BVerfGG; recusation of members of the Federal Constitutional Court; a motion is manifestly inadmissible if it contains only submissions objectively incapable of substantiating a concern of bias. In such a case no prior statement of the challenged judges is required, and those judges are not excluded from participating in the decision if the panel rules assign them to do so (consid. 1). § 90 BVerfGG, § 93d Abs. 1 S. 3 BVerfGG; a constitutional complaint that is inadmissible is not admitted to decision, and further reasoning may be dispensed with (consid. 2-3).

Key legal question

Whether the constitutional complaint should be admitted for decision

Extracted holding

The complaint was not admitted because it was inadmissible.

Extracted reasoning

The Court found no basis to proceed with the complaint and therefore abstained from giving further reasons under § 93d Abs. 1 sentence 3 BVerfGG.
