The Second Senate of the Federal Constitutional Court dismissed an election review complaint. The decision states that the complaint failed for the reasons given in the rapporteur’s letter of 12 April 2016 and that, pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, no further reasons were provided.
§ 26 Abs. 3 S. 3 EuWG i.V.m. § 24 S. 2 BVerfGG; election review complaint may be dismissed without further reasons if the Senate refers to the reasons stated by the rapporteur. The court may dispense with a detailed statement of reasons where the complaint plainly lacks success for the reasons already communicated (consid. 1).
