Omnilex summary

The Federal Constitutional Court again repeated its interim order suspending extradition of a U.S. citizen to Italy. It held that repetition is permissible where the conditions for the original interim order still exist. The order was extended for six more months, but no longer than until the constitutional complaint is decided.

Omnilex headnote

§ 32 Abs. 6 Satz 2 BVerfGG; repetition of an interim order: An interim order may be repeated if the statutory prerequisites for its initial issuance continue to exist. The Court does not re-examine the merits de novo, but assesses whether the factual and legal circumstances underlying the original balancing have materially changed. If no such change is shown, the previously ordered provisional protection may be extended for a further limited period, at the latest until the main constitutional complaint is decided (consid. 1).

BVerfGE 21, 50; 89, 113 <115 f.>; 97, 102 <102>). Dies ist vorliegend der Fall. Zur Begründung wird auf den Beschluss der 3. Kammer des Zweiten Senats vom 27. November 2014 verwiesen.
