Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint. It held that the filing was manifestly out of time because an inadmissible legal remedy, later withdrawn after judicial warning, does not suspend or extend the one-month complaint period. The complaint was also inadmissible because the complainant had not exhausted legal remedies, in particular by filing an Anhörungsrüge under § 78a ArbGG. In addition, the submission failed to meet the statutory substantiation requirements. The Court therefore dispensed with further reasoning and the decision is final.

§ 93 Abs. 1 S. 1, § 90 Abs. 2 S. 1, § 23 Abs. 1 S. 2 Halbs.

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was filed within the statutory complaint period.

Extracted holding

The complaint was out of time; an inadmissible remedy that was withdrawn after judicial indication does not extend the complaint period.

Extracted reasoning

The Court held that the filing of a remedy that is plainly inadmissible does not keep the one-month period open, even if it is later withdrawn after a judge’s warning.

Key legal question

Whether the requirement of exhaustion of legal remedies was satisfied.

Extracted holding

No; because no Anhörungsrüge under § 78a ArbGG was filed, the legal remedies were not exhausted.

Extracted reasoning

Without the available hearing complaint, the complainant had not exhausted the ordinary legal path before turning to the Constitutional Court.

Key legal question

Whether the constitutional complaint met the substantiation requirements.

Extracted holding

No; the complaint did not remotely satisfy the requirements of a sufficiently substantiated filing.

Extracted reasoning

The submission failed to comply with the statutory requirements for presenting the complaint in a comprehensible and substantively supported manner.
