Omnilex summary

The Federal Constitutional Court did not accept the constitutional complaint. After the complaint was filed, the complainant reached a settlement with the opposing party in the underlying labour dispute. The Court held that, because performance of the settlement also settled the underlying claims, a remittal could no longer lead to a more favorable outcome for the complainant. The complaint therefore lacked the need for enforcement-based acceptance under § 93a(2)(b) BVerfGG.

Omnilex headnote

§ 93a Abs. 2 lit. b BVerfGG; constitutional complaint not accepted where a subsequent settlement eliminates any prospect of a more favorable outcome on remittal. Acceptance for enforcement purposes is excluded if, by concluding a settlement that also resolves the substantive claims in dispute, the complainant no longer has a practical legal interest in further constitutional review; a remittal cannot then improve the complainant's position (cf. BVerfGE 90, 22 <24 f.>).

Titelzeile

Key legal question

Whether the constitutional complaint should be accepted for decision under § 93a(2)(b) BVerfGG to enforce the asserted rights.

Extracted holding

Acceptance was not required because, after the settlement, even a remittal could no longer produce a more favorable result for the complainant; the underlying claims were already settled.

Extracted reasoning

The Court held that the settlement concluded after the constitutional complaint was filed extinguished the practical benefit of further review. Because performance under the settlement also resolved the claims underlying the labour dispute, a remittal could not improve the complainant's position.
