Data storage limits must follow informational self-determination

Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint against OLG Hamm decisions on continued storage of data in an IT system. It held that technical constraints of a data-processing system cannot justify storing data that are otherwise unnecessary, because the requirements of informational self-determination govern the design of data processing. In the concrete case, however, the OLG's additional reasons made the continued storage appear defensible for effective performance of the authority's tasks. The complaint therefore failed to show a violation of fundamental rights.

Omnilex headnote

Art. 1 Abs. 1, Art. 2 Abs. 1 GG; informational self-determination and technical design of data-processing systems; continued storage of unnecessary data is not justified merely because system technology does not permit selective deletion. The constitutional requirements bind the organization of the data-processing system, not the reverse. Nevertheless, continued storage may remain permissible if, on the overall assessment, it is still necessary for effective fulfillment of public tasks (consid. 1).

Titelzeile

Key legal question

Whether the constitutional complaint showed a violation of informational self-determination by continued data storage in an IT system with limited deletion capabilities.

Extracted holding

The complaint did not establish a violation; technical limitations of a data-processing system cannot justify unnecessary storage, but the OLG's overall assessment that continued storage was still defensible for effective task performance was within the permissible judicial margin.

Extracted reasoning

The Court stated that technical constraints of data processing must conform to the requirements of informational self-determination, not vice versa. On the facts, however, the OLG's further reasoning allowed the continued storage to appear justifiable.
