Non-admission of constitutional complaint without reasons

BVerfG 2 BvR 126/15Bverfg / 2. Senat 2. KammerJan 28, 2015Dismissed

Summary

The Federal Constitutional Court, sitting as a chamber of the Second Senate, did not admit the constitutional complaint for decision. Because of that disposition, the applicant’s request for an interim injunction was no longer to be decided separately and was thereby rendered moot. The order is final and not subject to appeal.

Regest

§ 93d Abs. 1 S. 3 BVerfGG; non-admission of a constitutional complaint in chamber proceedings without reasons. Where a constitutional complaint is not admitted for decision by chamber order, ancillary requests for interim relief become moot if they are dependent on the pending constitutional complaint. The chamber may dispose of such applications summarily without further reasoning; the decision is final and not subject to appeal.
