BVerfG 2 BvR 2446/14 ΓÇó Constitutional complaint inadmissible without valid power of attorney
BVerfG 2 BvR 2446/14Bverfg / 2. Senat 2. KammerOct 24, 2014Inadmissible
The Federal Constitutional Court did not admit the constitutional complaint because the power of attorney granted merely “for constitutional complaint” did not expressly refer to the specific proceedings as required by Section 22(2) sentence 2 BVerfGG. As a consequence, the application for interim relief was moot. The decision is final and not subject to appeal.
§ 22 Abs. 2 S. 2 BVerfGG; admissibility of constitutional complaints depends on an express authorization referring to the конкретe proceedings. A merely general power of attorney “for constitutional complaint” does not satisfy the statutory form requirement if it does not identify the pending procedure in a specific manner. Failure to comply with this requirement renders the constitutional complaint inadmissible and prevents the Court from entering into the merits; ancillary requests for interim relief fall away with the non-admission decision.
