Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint. It held that the complaint had no prospect of success under § 93a para. 2 BVerfGG. The Court noted, however, that the prison court had interpreted the complainant's procedural declaration in a difficult-to-follow way as a withdrawal rather than treating the matter as terminated and deciding costs according to equity under § 121 para. 2 sentence 2 StVollzG, possibly because the prison administration had already complied with the request regarding the mini-disc player. No further reasons were given.

Omnilex headnote

Key legal question

Whether the constitutional complaint should be admitted for decision under § 93a para. 2 BVerfGG.

Extracted holding

The complaint was not admitted because it offered no prospect of success.

Extracted reasoning

The Court considered the complaint plainly unsuccessful and therefore refused admission; no further reasoning was given.

Key legal question

Whether the lower court's interpretation of the complainant's procedural statement and cost decision in prison-law proceedings violated constitutional rights.

Extracted holding

Even if the lower court's construction was hard to understand, this did not justify admission of the complaint.

Extracted reasoning

The complaint lacked prospects of success despite the arguably questionable treatment of the statement; costs should, in the Court's view, have been decided by equity under § 121 para. 2 sentence 2 StVollzG if performance or mootness had occurred.
