The Federal Constitutional Court did not admit the constitutional complaint. It held that § 2077(1) sentence 1 BGB, which renders testamentary dispositions in favor of a spouse ineffective upon fulfillment of divorce prerequisites, is compatible with Art. 6(1) GG. The Court found no fundamental constitutional significance and no need to enforce the alleged rights under § 93a(2) BVerfGG, and therefore gave no further reasoning under § 93d(1) sentence 3 BVerfGG.
Art. 6 Abs. 1 GG; § 2077 Abs. 1 Satz 1 BGB; non-admission of a constitutional complaint challenging the premature invalidity of testamentary dispositions in favor of a spouse. The requirement that divorce prerequisites exist and that both spouses have manifested that the marriage is broken down does not infringe the institutional guarantee or the freedom dimension of marriage protection. Where the legislature ties the lapse of a spousal testamentary disposition to the objectively established breakdown of the marriage, it pursues a constitutionally permissible delimitation of the deceased's presumed will and of spousal status; no Art. 6(1) GG violation arises from the mere fact that the disposition becomes ineffective before divorce is formally pronounced (consid. 2).

Nichtannahmebeschluss: Voraussetzung des § 2077 Abs 1 S 1 BGB für Unwirksamkeit letztwilliger Verfügungen zugunsten Ehegatten mit Art 6 Abs 1 GG vereinbar
1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, da die Voraussetzungen des § 93a Abs. 2 BVerfGG nicht vorliegen. Die Verfassungsbeschwerde hat keine grundsätzliche verfassungsrechtliche Bedeutung. Ihre Annahme ist auch nicht zur Durchsetzung der von der Beschwerdeführerin als verletzt gerügten Rechte angezeigt.
2 Art. 6 Abs. 1 GG wird weder in seiner Bedeutung als Institutsgarantie noch als Freiheitsrecht beeinträchtigt, weil die vorzeitige Unwirksamkeit einer Verfügung von Todes wegen zugunsten des Ehegatten in § 2077 Abs. 1 Satz 1 BGB voraussetzt, dass die Scheidungsvoraussetzungen vorliegen und beide Ehegatten zu erkennen gegeben haben, dass sie ihre Ehe als gescheitert ansehen und deshalb nicht mehr an ihr festhalten wollen.
3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
4 Diese Entscheidung ist unanfechtbar.
