Omnilex summary

The Federal Constitutional Court did not admit the constitutional complaint concerning the retention of money sent to a prisoner. It held the complaint inadmissible for lack of sufficient substantiation and, in any event, manifestly unfounded because the complainant offered no substantive rebuttal to the prison authorities' and lower courts' assumption of a link to unlawful, possibly drug-related dealings. The Court also found the filing abusive and imposed a misuse fee of EUR 50 under § 34(2) BVerfGG.

Omnilex headnote

§ 34 Abs. 2 BVerfGG; constitutional complaint obviously inadmissible or manifestly unfounded as abuse of process; a misuse fee may be imposed where the filing is, from the standpoint of any reasonable person, completely hopeless. The Federal Constitutional Court is not required to tolerate the wasteful occupation of its limited adjudicatory capacity by applications lacking any substantiated constitutional argumentation (consid. 2). Where the complainant fails to engage in a substantively supported manner with the decisive findings of the specialist courts, the complaint is already inadmissible for insufficient substantiation and may additionally be treated as manifestly unfounded.

Nichtannahme einer mangels hinreichender Begründung unzulässigen und zudem offensichtlich unbegründeten Verfassungsbeschwerde - Missbrauchsgebühr iHv 50 Euro

Tenor

Extracted by Omnilex

Key legal question

Whether the constitutional complaint was admissible and sufficiently substantiated.

Extracted holding

The complaint was not admitted because it lacked sufficient reasoning and was therefore inadmissible; in any event, it was also manifestly unfounded.

Extracted reasoning

The complainant did not provide any substantively supported response to the prison and lower courts' assumption that the anonymous money transfers of €150 each were connected to unlawful, possibly drug-related dealings.

Key legal question

Whether a misuse fee should be imposed under § 34(2) BVerfGG.

Extracted holding

A misuse fee of €50 was imposed because filing the complaint was abusive.

Extracted reasoning

An appeal is abusive where it is obviously inadmissible or unfounded and a reasonable person would view its filing as completely hopeless; the Court need not accept the wasteful use of its capacity.
