Omnilex summary

The Federal Constitutional Court held that the two constitutional complaints did not satisfy the admission requirements. They lacked fundamental constitutional significance and offered no prospect of success. On the basis of the submissions, no indication was found that the challenged Frankfurt decisions violated the complainants' constitutional rights. The Court therefore declined to give any further reasons and noted that the decision is final.

Omnilex headnote

§ 93a Abs. 2 BVerfGG; admission of a constitutional complaint and prospects of success: A constitutional complaint is not to be admitted where it lacks fundamental constitutional significance and is not necessary for the enforcement of constitutional rights because it manifestly has no prospect of success. The Federal Constitutional Court will refrain from further reasoning under § 93d Abs. 1 sentence 3 BVerfGG when no indications of a constitutional violation emerge from the submissions. The non-admission decision is final.

Titelzeile

Key legal question

Whether the constitutional complaints had to be admitted for decision under the admissibility criteria

Extracted holding

The complaints were not admitted because they raised no question of fundamental constitutional importance and had no prospect of success; no violation of rights was apparent.

Extracted reasoning

Under Section 93a(2) BVerfGG, admission was unwarranted. The Court found no indications, on the basis of the complaints, that the challenged decisions infringed the alleged constitutional rights.
