Omnilex summary

The Federal Constitutional Court refused to admit the constitutional complaint against a Federal Social Court judgment. It held that the complaint was inadmissible because it was not sufficiently substantiated: the complainant failed to engage with the challenged judgment and merely relied on a third party's draft complaint, which itself did not satisfy the pleading requirements. The Court therefore declined to give further reasons and held the decision unappealable.

Omnilex headnote

§§ 23 Abs. 1 S. 2, 92, 93a Abs. 2 BVerfGG; substantiation requirements for a constitutional complaint against a judgment. A constitutional complaint must identify, in a substantiated manner, the constitutional provisions allegedly infringed and must address the challenged decision together with its specific reasoning. A mere refusal to engage with the impugned judgment does not satisfy the duty of substantiation. Reference to a third party's draft complaint cannot cure this defect if that draft likewise fails to meet the statutory pleading requirements (consid. 2 f.).

Titelzeile

Key legal question

Whether the constitutional complaint was sufficiently substantiated under §§ 23(1) sentence 2 and 92 BVerfGG.

Extracted holding

No. The complaint did not set out in a substantiated manner how the challenged measure conflicted with constitutional requirements.

Extracted reasoning

A constitutional complaint must explain the alleged constitutional violation and, when directed against a judgment, address the challenged decision and its specific reasoning. The complainant expressly refused to engage with the BSG judgment; this deficiency could not be cured by referring to an attached draft complaint by a third party, which itself failed to meet the substantiation requirements.
