Gründe

1 Die Rechtssatzverfassungsbeschwerde ist - unbeschadet der Frage ihrer fristgerechten Erhebung - unzulässig. Der privat krankenversicherte Beschwerdeführer ist durch die angegriffene Bestimmung des § 221 Abs. 1 SGB V in der Fassung des GKV-Wettbewerbsstärkungsgesetzes vom 26. März 2007 nicht selbst, unmittelbar und gegenwärtig betroffen.

2 Die Bestimmung regelt die Höhe des Bundeszuschusses zur gesetzlichen Krankenversicherung. Der einzelne Bürger, der eine bestimmte Verwendung des Aufkommens aus öffentlichen Abgaben für grundgesetzwidrig hält, kann aus seinen Grundrechten regelmäßig keinen Anspruch auf generelles Unterlassen einer solchen Verwendung herleiten (vgl. BVerfGE 67, 26 <37> und Beschluss der 2. Kammer des Zweiten Senats vom 2. Oktober 2001 - 2 BvR 1594/01). Der Beschwerdeführer kann daher aus Art. 3 Abs. 1 in Verbindung mit Art. 6 Abs. 1 GG nicht die beantragte Feststellung herleiten, dass die gerügte Mittelverwendung in § 221 Abs. 1 SGB V nichtig sei.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
