Omnilex summary

The Federal Court of Justice rejected the defendant's revision against the Landgericht Bochum judgment as unfounded. It also dismissed her immediate complaint against the costs order. The court held that under § 464(3) StPO only the basic allocation of costs may be reviewed by immediate complaint; objections to individual cost items, including translation costs arising from telephone interception, belong in the cost assessment procedure under § 19(2) GKG. The defendant had not challenged the underlying cost allocation, and no exceptional case under § 465(2) StPO existed.

Omnilex headnote

§ 464 Abs. 3 StPO; § 19 Abs. 2 GKG; cost complaint against individual items and translation costs from telephone interception; immediate complaint is limited to review of the basic cost allocation and does not permit examination of the recoverability of individual cost items. Such objections must be pursued in the cost assessment procedure under § 19 Abs. 2 GKG. This also applies to translation costs incurred because of telephone interception measures; an exception under § 465 Abs. 2 StPO requires special grounds and is not lightly assumed.

Spruchkörper: 4. Strafsenat

Tenor

Key legal question

Whether the criminal revision against the Landgericht Bochum judgment was well founded.

Extracted holding

The revision was unfounded; the review disclosed no legal error to the defendant's detriment.

Extracted reasoning

The Federal Court of Justice found no reviewable error under the revision grounds.

Key legal question

Whether the immediate complaint could challenge individual cost items, especially translation costs from telephone interception material.

Extracted holding

The complaint was inadmissible insofar as it attacked individual cost items; under § 464(3) StPO only the basic cost allocation can be reviewed, while the question of which individual items are recoverable is decided in the cost assessment procedure under § 19(2) GKG.

Extracted reasoning

The defendant did not object to the underlying cost allocation itself. Translation costs caused by telephone interception are also addressed in the cost assessment procedure; no exceptional case under § 465(2) StPO was present.
