Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Bochum vom 15. Juli 2016 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend zu den Ausführungen des Generalbundesanwalts in seiner Antragsschrift vom 25. November 2016 bemerkt der Senat:

Die Annahme des Landgerichts, das sichergestellte Reizstoffsprühgerät der Marke „Walther/ProSecur“ sei als (sonstige) Waffe im technischen Sinne gemäß § 1 Abs. 2 Nr. 2 Buchst. a WaffG i.V.m. Anlage 1 zu § 1 Abs. 4 WaffG, Abschnitt 1, Unterabschnitt 2, Nr. 1.2.2 zu qualifizieren, die ihrem Wesen nach geeignet und dazu bestimmt ist, die Angriffs- oder Abwehrfähigkeit von Menschen herabzusetzen, ist aus Rechtsgründen nicht zu beanstanden. Diese Eigenschaft wird dadurch, dass der Umgang mit dem Sprühgerät nach § 2 Abs. 2, 3 WaffG i.V.m. Anlage 2 zu § 2 Abs. 2 bis 4 WaffG, Abschnitt 1, Nr. 1.3.5 möglicherweise erlaubnisfrei ist, nicht in Frage gestellt.
