Revisionsverwerfung im Strafverfahren: Unterlassene Prüfung der Zäsurwirkung im Rahmen der Gesamtstrafenbildung

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Stendal vom 20. September 2016 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO). Jedoch wird die Feststellungsentscheidung im Adhäsionsausspruch dahingehend klargestellt, dass sich entsprechend den Urteilsgründen (UA S. 23) die Eintrittspflicht des Angeklagten auf zukünftige materielle und immaterielle Schäden bezieht.

Der Beschwerdeführer hat die Kosten des Rechtsmittels, die der Neben- und Adhäsionsklägerin im Revisionsverfahren erwachsenen notwendigen Auslagen sowie die insoweit durch das Adhäsionsverfahren entstandenen besonderen Kosten zu tragen.

Ergänzend zu der Antragsschrift des Generalbundesanwalts bemerkt der Senat:

Zwar teilt das angefochtene Urteil nicht mit, ob die Geldstrafe aus dem Urteil des Amtsgerichts Magdeburg vom 7. Februar 2013 erledigt ist, so dass der Senat nicht prüfen kann, ob dieser Verurteilung Zäsurwirkung zukommt und aus der Geldstrafe sowie der Strafe für die Tat zu II.1.a der Urteilsgründe eine (erste) Gesamtstrafe zu bilden gewesen wäre. Eine diesbezügliche Beschwer des Angeklagten ist jedoch ausgeschlossen, da sowohl bei der ersten Gesamtstrafe als auch bei der aus den vier weiteren Taten zu bildenden zweiten Gesamtstrafe jeweils eine Gesamtfreiheitsstrafe von mindestens zwei Jahren und sieben Monaten festzusetzen gewesen wäre und sich dadurch für den Angeklagten ein größeres Gesamtstrafübel ergeben hätte.
