Omnilex summary

The Federal Court of Justice rejected the plaintiffs' non-admission complaint in a consumer loan case. It held that the matter had no fundamental importance and that neither development of the law nor uniformity of case law required a revision. The Senate also examined the prospects of success of a revision and found none. In particular, it saw no reason to challenge the appellate court’s view that § 355(2) sentence 1 BGB, in its former version, is satisfied when co-borrowers obtain joint possession of a written withdrawal notice. The plaintiffs were ordered to bear the costs of the complaint proceedings.

Omnilex headnote

§ 543 Abs. 2 Satz 1 ZPO, § 355 Abs. 2 Satz 1 BGB (old version); non-admission complaint and withdrawal notice to multiple co-borrowers. A revision is admitted only where the case has fundamental significance or where development of the law or safeguarding uniform jurisprudence requires a decision of the court of revision. In assessing these grounds, the court may also examine the prospects of success of the intended revision. For § 355 Abs. 2 Satz 1 BGB a written withdrawal notice can be sufficiently communicated when co-borrowers obtain joint possession of the notice in text form; no further individual transmission is required (consid. unspecified).

Tenor

Januar 2016 - 23 U 42/15, juris Rn. 25 ff.; OLG Hamm, WM 2016, 116, 122 f.; Bülow, WuB 2016, 207, 210; Martis/Meinhof, MDR 2004, 4, 6; MünchKommBGB/Fritsche, 7. Aufl., § 355 Rn. 30 Fn. 48; Staudinger/Kaiser, BGB, Neubearb. 2012, § 355 Rn. 55; aA Knops/Martens, WM 2015, 2025, 2027 f.).

Key legal question

Whether the non-admission complaint against the OLG Celle decision had sufficient prospects for a revision to be admitted.

Extracted holding

The complaint was rejected because the case had no fundamental significance and did not require review to develop the law or ensure uniform case law.

Extracted reasoning

The Senate reviewed the prospects of success of a revision and found none; therefore the statutory grounds for admission were absent.

Key legal question

Whether service of a written withdrawal notice on co-borrowers satisfied § 355(2) sentence 1 BGB in its old version.

Extracted holding

Yes, the appellate court correctly assumed the statutory requirements were met when co-borrowers obtained joint possession of a withdrawal notice in text form.

Extracted reasoning

The court treated this question as settled against the plaintiffs' request for further review and saw no need to depart from the appellate court's view.
