Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Landshut vom 26. Oktober 2016 wird als unbegründet verworfen (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Der Schuldspruch auch wegen sexuellen Missbrauchs widerstandsunfähiger Personen nach § 179 StGB aF ist im Ergebnis rechtlich nicht zu beanstanden. Zwar wurde die Vorschrift des sexuellen Missbrauchs widerstandsunfähiger Personen (§ 179 StGB) mit Gesetz zur Verbesserung des Schutzes der sexuellen Selbstbestimmung vom 4. November 2016 (BGBl. 2016 I, 2460), das am 10. November 2016 in Kraft trat, nach Verkündung des Urteils des Landgerichts Landshut vom 26. Oktober 2016 aufgehoben. Dies ist im Revisionsverfahren gemäß § 354a StPO, § 2 Abs. 3 StGB zu beachten. Jedoch ist § 179 StGB aF gleichzeitig in § 177 StGB eingefügt worden, wodurch das Verhalten des Angeklagten auch weiterhin unter Strafe gestellt ist. § 177 StGB nF (sexueller Übergriff; sexuelle Nötigung; Vergewaltigung) stellt im Sinne notwendiger Unrechtskontinuität eine Nachfolgeregelung zu § 179 StGB dar; denn sowohl das Schutzgut als auch die inkriminierte Angriffsrichtung sind unverändert geblieben. Die Taten des Angeklagten konnten, da das jetzt geltende Recht nicht das mildere Gesetz ist (§ 2 Abs. 3 StGB), weiter nach § 179 StGB aF strafrechtlich geahndet werden.
