  1. Auf die Revision des Angeklagten wird das Urteil des Landgerichts Krefeld vom 28. September 2016 aufgehoben, soweit das Landgericht folgende Gegenstände eingezogen hat: 103,689 Gramm Marihuanaprodukte, 7,392 Gramm Amphetamin, 1 Joint, 55,61 Gramm Marihuanastengel sowie eine schwarze Sporttasche "Runaway"; diese Anordnung entfällt.

  2. Die weitergehende Revision wird verworfen.

  3. Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Gründe

1 Das Landgericht hat den Angeklagten wegen Handeltreibens mit Betäubungsmitteln in nicht geringer Menge zu einer Freiheitsstrafe von fünf Jahren verurteilt und sichergestelltes "Rauschgift (4.384,289 Gramm Cannabismaterialien und 7,392 Gramm Amphetaminsulfatzubereitung, 1 Joint sowie 55,61 Gramm Marihuanastengel)" sowie unter anderem eine Sporttasche "Runaway" eingezogen. Hiergegen wendet sich der Beschwerdeführer mit seiner auf die Rüge der Verletzung materiellen Rechts gestützten Revision. Das Rechtsmittel hat den aus der Entscheidungsformel ersichtlichen Teilerfolg; im Übrigen ist es unbegründet im Sinne von § 349 Abs. 2 StPO.

2 Die auf die Sachrüge veranlasste umfassende materiellrechtliche Überprüfung des Urteils hat zum Schuldspruch keinen Rechtsfehler zum Nachteil des Angeklagten ergeben. Auch der Rechtsfolgenausspruch erweist sich mit der Ausnahme der Einziehungsentscheidung als rechtsfehlerfrei. Hierzu gilt:

3 Hinsichtlich des Rauschgifts kommt eine Einziehung nur nach § 33 Abs. 2 Satz 1 BtMG in Betracht. Voraussetzung der Einziehung nach dieser Vorschrift ist, dass die Betäubungsmittel Gegenstand der von der Anklage umschriebenen und vom Gericht festgestellten Tat sind (BGH, Beschlüsse vom 5. März 2002 - 3 StR 491/01, NJW 2002, 1810, 1811 mwN; vom 13. September 2011 - 3 StR 277/11, juris Rn. 2). Dies ist hinsichtlich der in Küche und Wohnzimmer sichergestellten rund 104 Gramm "Marihuanaprodukte", der 7,4 Gramm Amphetamin, des Joints sowie des Beutels mit Marihuanastengeln nicht der Fall. Das Landgericht hat diese Drogen nicht der von der Anklage erfassten Tat zuordnen können.

4 Keinen Bestand hat auch die Einziehung der schwarzen Sporttasche "Runaway". Diese vom Lieferanten des Angeklagten zum Drogentransport verwendete Tasche steht weder im Eigentum des Angeklagten (§ 74 Abs. 2 Nr. 1 StGB) noch ist sie im Sinne des § 74 Abs. 2 Nr. 2 StGB gefährlich.

5 Da der Ausspruch über die Einziehung insoweit nur wegen einer Gesetzesverletzung bei Anwendung des Gesetzes auf die dem Urteil zugrunde liegenden Feststellungen aufzuheben ist, entscheidet der Senat entsprechend § 354 Abs. 1 StPO in der Sache selbst dahin, dass die Anordnung der Einziehung in dem aus der Beschlussformel ersichtlichen Umfang entfällt (vgl. BGH, Beschlüsse vom 13. September 2011 - 3 StR 277/11, juris Rn. 3; vom 29. November 2016 - 3 StR 374/16, juris Rn. 2).

6 Im Hinblick auf den nur geringen Teilerfolg der Revision ist es nicht unbillig, den Beschwerdeführer mit den gesamten durch sein Rechtsmittel entstandenen Kosten und Auslagen zu belasten (§ 473 Abs. 1 und 4 StPO).
