Omnilex summary

The Federal Court of Justice dismissed the defendants' revisions against the Regional Court of Meiningen. It held that the review raised no legal error to the defendants' detriment. The Senate did not decide whether to follow newer case law on the dangerousness of methamphetamine, because it could exclude that the challenged judgment depended on the lower court's characterization of the drug as particularly dangerous. Each defendant was ordered to bear the costs of his own appeal.

Omnilex headnote

§ 349 Abs. 2 StPO; revision without success where the appellate court can exclude that the judgment rests on the contested legal assessment of the drug's dangerousness. A separate clarification of whether newer case law on methamphetamine's danger is to be followed is unnecessary if the conviction or sentence does not depend on that point. The decisive question is whether the challenged reasoning influenced the outcome; if not, the judgment stands notwithstanding a possible error in the abstract characterization of the substance (consid. not stated).

Vorinstanz: vorgehend LG Meiningen, 28. Dezember 2015, Az: 850 Js 22827/14 - 1 KLs

Spruchkörper: 2. Strafsenat

Titelzeile

Key legal question

Whether the defendants' revisions against the Regional Court judgment were well-founded.

Extracted holding

The revisions were unfounded; the review disclosed no legal error detrimental to the defendants.

Extracted reasoning

The Senate found no reversible defect in the judgment on the basis of the revision arguments.

Key legal question

Whether the judgment had to be set aside because of the sentencing court's characterization of methamphetamine as highly dangerous.

Extracted holding

No. The Senate excluded that the challenged judgment rested on that characterization, so the issue did not affect the outcome.

Extracted reasoning

Even assuming a different assessment of methamphetamine's danger, it could be ruled out that the lower court's decision depended on that point.
