Omnilex summary

The Federal Court of Justice rejected the defendant’s revision against the Chemnitz Regional Court judgment. The only relevant complaint concerned an alleged breach of the court’s duty to disclose plea-related discussions under § 243(4) sentence 1 StPO. The Senate held that the discussions had taken place in a public main hearing before the case was referred under § 270(1) StPO, in the presence of the defendant and his counsel, and therefore were not covered by the statutory notification duty. No analogous application of § 243(4) StPO was justified. The revision was therefore unfounded and the defendant had to bear the costs.

Omnilex headnote

Key legal question

Whether the court had to notify plea-related discussions under § 243(4) sentence 1 StPO for talks held in a public hearing before referral under § 270(1) StPO.

Extracted holding

No. The discussions were not talks within §§ 202a, 212 StPO, but were held in a public main hearing in the presence of the defendant and defense counsel; no analogous application of § 243(4) sentence 1 StPO was warranted.

Extracted reasoning

The statutory notification duty is aimed at plea-related talks conducted outside a public main hearing. Here, the talks took place openly before the Schöffengericht with the defendant and counsel present, so the rationale for the disclosure requirement did not apply.
