Partial value request denied for hopeless appeal

BGH II ZR 134/09Bgh / Civil Chamber IIFeb 22, 2012Dismissed

Summary

The Federal Court of Justice rejected the plaintiff’s request to fix a partial amount in dispute for court costs. It held that, even apart from the question of timeliness under § 247 Abs. 3 Satz 2 AktG, such a request may be denied when the underlying appellate pursuit is wholly hopeless or vexatious. Here, the lower court had dismissed the action and refused leave to appeal, and the non-admission complaint had already been dismissed because no grounds for admission were present.

Regest

§ 247 Abs. 2 S. 1 AktG; request for fixation of a partial amount in dispute for court costs may be refused where the appellate pursuit is entirely hopeless or vexatious. The court may deny the motion irrespective of whether it was filed in time under § 247 Abs. 3 S. 2 AktG, if the party's legal recourse lacks any realistic prospect of success. A prior dismissal of the action and refusal of leave to appeal, confirmed by rejection of the non-admission complaint for lack of grounds for admission, support the conclusion of complete futility.

Titelzeile

Festsetzung eines Teilstreitwerts bei völlig aussichtslosem Beschwerdeverfahren

Tenor
