Die Anhörungsrüge des Antragstellers vom 12. April 2017 gegen den Beschluss des Senats vom 16. März 2017 wird auf seine Kosten zurückgewiesen.

Der (erneute) Antrag des Antragstellers vom 12. April 2017 auf Bewilligung von Prozesskostenhilfe für eine Entschädigungsklage nach §§ 198 ff GVG i.V.m. § 128b PatG wird abgelehnt.

Gründe

1 1. Die Anhörungsrüge gegen den Senatsbeschluss vom 16. März 2017 ist unbegründet.

2 Der Senat hat bei seiner Entscheidung die Ausführungen des Antragstellers in vollem Umfang zur Kenntnis genommen und in Erwägung gezogen. Er hat das Vorbringen jedoch als nicht durchgreifend erachtet. Wenn das Gericht eine andere Rechtsauffassung einnimmt, als der Antragsteller sich dies wünscht, stellt diese keine Verletzung des Rechts auf Gewährung rechtlichen Gehörs dar (vgl. BVerfGE 64, 1, 12). Es bestand deshalb auch keine Veranlassung, dem Antragsteller einen Hinweis nach § 139 ZPO zu erteilen.

Der (erneute) Antrag auf Gewährung von Prozesskostenhilfe für eine Entschädigungsklage nach §§ 198 ff GVG wegen angeblich verzögerter Entscheidung des Bundespatentgerichts über den Verfahrenskostenhilfeantrag vom 4. August 2016 bietet keine hinreichende Aussicht auf Erfolg. Zur Begründung wird auf den Beschluss vom 16. März 2017 Bezug genommen. Lediglich ergänzend bemerkt der Senat, dass eine Entschädigung wegen unangemessener Verfahrensdauer vor dem Bundespatentgericht schon deshalb ausscheidet, weil das Faxschreiben des Antragstellers vom 4. August 2016 an diesen mit dem Hinweis zurückgesandt worden ist, dass beim Bundespatentgericht kein Verfahren anhängig sei. Es fehlt somit bereits an der Einleitung eines Gerichtsverfahrens im Sinne des § 198 Abs. 6 Nr. 1 GVG, dessen Dauer Gegenstand einer Entschädigungsklage sein könnte.

4 Der Antragsteller kann mit der Bescheidung weiterer Eingaben in dieser Sache nicht mehr rechnen.
