Omnilex summary

The Federal Labour Court partially allowed the defendant’s revision. It set aside the Higher Labour Court’s judgment in part and amended the Labour Court’s judgment to reject the claim for payroll statements. The remainder of the payment order was left standing, with the clarification that the amount is gross and interest runs only from 2013-01-08. Costs were apportioned across the three instances according to the tenor.

Omnilex headnote

In revision proceedings before the Federal Labour Court, a judgment may be partially set aside and amended where only part of the operative part is legally objectionable; the remaining payment order can be upheld with clarification of the gross character of the award and the commencement of default interest. A separate claim for issuance of payroll statements may be rejected while the monetary claim otherwise remains in force. Costs are to be allocated in accordance with the parties’ respective success and failure in each instance.
